MANDATORY ARBITRATION PROVISIONS: When They Are Enforceable and Why You Want Them -- Avoiding a Jury Trial, Punitive Exposure Recent USSC Decisions on Point; Use to reduce risk; e.g., insurance policy provisions, identity of arbitrator or organization; practice pointers; general clauses sometimes do not take advantage of USSC decisions enforcing. What could be included in arbitration clauses to fence in the dispute and reduce corporations' risk. Enforcing arbitration clauses, conducting the arbitration. Should 3-arbitrator panels be eliminated? Elimination of remedies (e.g., punitive damages). Providing for the forum.
