With more than 300 jury research projects under his belt, Russ Mirabile of U.S. Aviation Underwriters has come to some conclusions that might surprise, including that jury research can be over-used and relied upon without cause. He identifies dangerous trends, including the flaw of being taken in by one's own rhetoric, failing to consider the impact of charismatic counsel on both sides, allowing social scientists to control issue selection and emphasis, result-skewing by predisposed clients seeking confirmation of their own preconceptions, absence of counsel ability-testing, filtration of findings for presentation to executives, and more.

Trial lawyers Mike Nilan and Rod Heard also speak from experience. While recognizing the advantage of knowing how a jury is likely to handle the issues in your case, they show us how to separate the alchemy from the science. They'll talk about their experience with jury research, including juror surveys (juror profile, venue and community attitude surveys), small group studies (focus groups, mock trials and trial simulations), case preparation (witness, evidence, opening statement, issue identification and closing argument preparation), jury selection (voir dire and juror questionnaires), post-trial juror interviews.
