FEDERAL SENTENCING GUIDELINES HEAVY-WEIGHT CHAMPIONSHIP
In this corner, Attorney General Ashcroft eliminates charge
bargaining, and a new law (the Feeney Amendment) closes downward
departure "loopholes" while keeping tabs on federal judges who
downwardly depart from the rules. And in the blue trunks, the
federal judiciary, led by the Judicial Conference of the United
States, declares that congressional restrictions on judicial
discretion in sentencing were passed without consultation and
should be repealed. Advice for counsels general; protective
action to take now no matter who wins. |

PANEL DISCUSSION ON
ASBESTOS LITIGATION: THE END?
2,000 companies have now been sued in asbestos litigation.
Proposed federal legislation may impact current litigation
strategies and long term forecasting. Remaining insurance
coverage may be insufficient. How the proposed $108B settlement
will be "collected" from the insurance industry and corporate
America. Prospects for passage - this year and next. Key
players provide historical perspective of the asbestos morass -
how we got here - and a discussion of the proposed legislation
to end it all. And, where goeth silica litigation? The next
asbestos?

PARALLEL CIVIL, CRIMINAL AND CONGRESSIONAL INVESTIGATIONS
Corporate wrongdoing was politically chic until recently. The
triple threat of civil lawsuits, criminal prosecutions and
congressional investigations. A white-collar criminal law
practitioner and former Congressional lawyer will lay out
practical, pro-active steps to avoid the potentially disastrous
consequences of parallel investigations. Particular focus on
questions of privilege, joint defense, 5th Amendment, stays of
civil proceedings, corporate governance, grand jury fundamentals
and practice before committees of Congress. |

OBLIGATIONS WHEN CONDUCTING INVESTIGATIONS OF MISCONDUCT
In
the post-Enron era, with the passage of the Sarbanes-Oxley Act
of 2002, questions regarding the impact of corporate internal
investigations abound. This new environment warrants a renewed
examination of ethical considerations involved when the
corporation’s counsel investigates possible wrongdoing within
the corporation. This presentation will address who, precisely,
is included within the attorney-client relationship; potential
conflicts of interest, which communications are confidential and
which are not; and what further communications are required of
corporate counsel as additional information is revealed. |

JURY RESEARCH PANEL DISCUSSION: WHAT WORKS AND WHAT DOESN'T
Mike Nilan, Discussion Moderator; Russ Mirabile (USAIG);
Rod Heard
With more than 300 jury research projects under his belt, Russ
Mirabile of U.S. Aviation Underwriters has come to some
conclusions that might surprise, including that jury research
can be over-used and relied upon without cause. He identifies
dangerous trends, including the flaw of being taken in by one's
own rhetoric, failing to consider the impact of charismatic
counsel on both sides, allowing social scientists to control
issue selection and emphasis, result-skewing by predisposed
clients seeking confirmation of their own preconceptions,
absence of counsel ability-testing, filtration of findings for
presentation to executives, and more.
Trial lawyers Mike Nilan and Rod Heard also speak from
experience. While recognizing the advantage of knowing how a
jury is likely to handle the issues in your case, they show us
how to separate the alchemy from the science. They'll talk about
their experience with jury research, including juror surveys
(juror profile, venue and community attitude surveys), small
group studies (focus groups, mock trials and trial simulations),
case preparation (witness, evidence, opening statement, issue
identification and closing argument preparation), jury selection
(voir dire and juror questionnaires), post-trial juror
interviews.
